Introducción: ¡Bienvenidos a La Fuente Cargo Corporation! Al utilizar los servicios que brindamos, usted reconoce que ha leído, entendido y acepta estar sujeto a nuestros Términos y condiciones. Estos Términos y Condiciones se extienden y aplican incondicionalmente a todos nuestros servicios. Si no está de acuerdo con todos estos Términos y condiciones, es posible que no podamos continuar brindando nuestros servicios. La Fuente Cargo Corporation recomienda que guarde o imprima una copia de estos Términos y condiciones para referencia futura.

Acuerdo con los términos:
Los Términos y Condiciones de La Fuente Cargo contenidos en este Acuerdo regirán su uso de nuestros servicios. Estos Términos describen las normas y reglamentos que rigen el uso de los servicios prestados por La Fuente Cargo. Toda la información/el contenido del paquete/los documentos/los servicios o todas las demás entidades proporcionadas por el cliente se administrarán con sujeción a estos Términos y condiciones. Estos Términos y condiciones se aplican en pleno vigor y efecto a su uso de nuestros servicios, y al darnos su envío usted acepta, independientemente de si firma o no nuestra hoja de ruta, para usted o como agente y en nombre de cualquier otra persona. tener un interés en este envío, con todos los términos y condiciones aquí contenidos en su totalidad. Nuestro nombre impreso será suficiente para constituir nuestra firma en nuestra carta de porte. También acepta los Términos y condiciones en nombre del destinatario del Envío y cualquier tercero con interés en el paquete. No continúe utilizando nuestros servicios si tiene alguna objeción a cualquiera de los Términos y condiciones establecidos en esta página. En caso de que cualquiera de estos Términos y Condiciones no sea respetado por el Cliente, podemos cancelar o suspender el acceso a nuestro Servicio de inmediato, con o sin previo aviso. Solo el personal autorizado de La Fuente Corporation puede cambiar los Términos y Condiciones de este acuerdo.

Sus obligaciones:
Usted es responsable de empacar adecuadamente sus productos y completar correctamente este contrato, describiendo cada artículo en este envío y brindando la información de contacto correcta. No nos hacemos responsables del deterioro de los bienes y aparatos eléctricos que no hayan sido debidamente embalados.

Usted garantiza que cada artículo en el envío se describe correctamente en su hoja de ruta y cualquier documento de exportación, aceptable para el transporte por nosotros, y debidamente marcado, dirigido y embalado para garantizar un transporte seguro con el cuidado habitual en el manejo.

Usted es responsable de enviar cualquier artículo electrónico en su embalaje original con seguro, presentar una factura de compra para justificar su valor declarado y pagar los impuestos correspondientes.

Costos adicionales:
Incluso si ya canceló el envío total o nos dió instrucciones de pago diferentes, también será responsable de cualquier costo adicional en el que la empresa tenga que incurrir en relación con su envío, tales como: sanciones y multas gubernamentales, impuestos, honorarios de abogados y costos legales, costos de almacenaje, entre otros; su carga puede ser retenida hasta que los costos adicionales sean pagados.

En caso de que su paquete tenga más peso del recomendado por nosotros para su seguridad en el transporte, usted es responsable de los costos adicionales o daños.

En caso de que la dirección de destino de la carga se encuentre dentro de una zona de difícil acceso o restringida por nuestro equipo de logística por razones de seguridad, el cliente es responsable de los costos adicionales que deba incurrir al trasladarse a un punto de entrega autorizado por nosotros.

Pagos:
Los pagos se pueden realizar con tarjeta de crédito, tarjeta de débito o en efectivo; otros métodos de pago pueden ser ofrecidos únicamente en nuestras oficinas principales, a través de nuestro sitio web o personal autorizado de La Fuente Cargo Corporation. No ofrecemos la opción de pagar nuestros servicios de envío a crédito o en cuotas, con excepción de circunstancias especiales aprobadas por personal autorizado de La Fuente Cargo Corporation.

Artículos NO permitidos para transportar:
Por ley, no se nos permite transportar ningún paquete que contenga oro, diamantes, plata, dinero, cheques personales, documentos personales, licor, explosivos, armas, drogas y otros objetos restringidos, peligrosos o prohibidos por las aduanas de los Estados Unidos o los países a los que enviamos. No somos responsables de la pérdida de los objetos restringidos mencionados anteriormente.

No seremos responsables:

• Para artículos electrónicos como tabletas, celulares, computadoras, electrodomésticos y otros dentro de una encomienda.
• Por sus actos u omisiones, incluidos, entre otros, el embalaje, la protección y el direccionamiento inadecuados o insuficientes. (VER CONSEJOS PARA EMPACAR CORRECTAMENTE)
• Para cualquier acuerdo realizado entre el cliente y un vendedor independiente o una persona que represente un lugar de entrega autorizado que no cumpla con nuestros términos y condiciones.
• Si usted o el destinatario viola cualquiera de los términos de este acuerdo.
• Por la pérdida o daño de cualquier artículo restringido o prohibido mencionado anteriormente.
• Por el decomiso por autoridades públicas de mercancías que no hayan sido declaradas como tales.
• Si los elementos faltantes que reclama no han sido previamente declarados y anotados en su factura.
• Por pérdidas, daños, retrasos o falta de información en relación con su envío causados por eventos que no podemos controlar, incluidos, entre otros, actos de Dios, peligros del aire, condiciones climáticas, actos de enemigos públicos, guerra, huelgas, civiles conmociones, actos u omisiones de las autoridades públicas (incluidos los funcionarios de aduanas y de salud) con autoridad real o aparente.

Límites de valor declarado:
Para el contenido de una encomienda, independientemente del destino, el valor máximo declarado es de US$1,000, salvo circunstancias especiales aprobadas por personal autorizado de La Fuente Cargo Corporation, tales como vestimenta o decoración para eventos familiares, bodas, cumpleaños, bautizos u otros regalos enviados a una familia. Todo valor declarado en cualquier envío tiene que ser justificado con una factura de compra.

Seguro Básico: El seguro es opcional, debe ofrecerse por nuestros agentes al cliente por cada guía facturada. La cobertura básica de seguro que exige la ley para encomiendas marítimas es por un máximo de $500 y para encomiendas aéreas $100, esto incluye el flete pagado. Cuando el cliente no asegura su carga, La Fuente Cargo brindará la cobertura de seguro básico que la ley exige. Si el cliente asegura su carga,en caso de reclamo, la declaración de los artículos en la guía y la presentación de los comprobantes ( facturas ) son requisitos para tramitar el reembolso. Artículos frágiles, electrónicos, electrodomésticos, equipos que van en la misma caja junto a otros artículos no tienen cobertura de seguro. Articulos fragiles, electronicos, electrodomesticos, equipos, muebles deben estar embalados correctamente con sus protectores para poder brindar cobertura de seguro. Artículos usados no tiene valor, sólamente si existe una factura comercial de estos. Pérdidas o daños parciales no tienen cobertura de seguro. (VEA LAS POLÍTICAS DE SEGURO PARA SU PAÍS DE DESTINO AQUÍ)

Entregas: Las entregas del envío se realizarán únicamente en la dirección indicada y al destinatario indicado en su factura. Aún si el remitente autoriza la entrega a un tercero, no nos hacemos responsables por el daño o la perdida de la carga. Si su dirección de destino se encuentra dentro de una zona de difícil acceso o restringida, realizaremos la entrega en el punto de entrega más cercano. (PREGUNTE POR NUESTROS PUNTOS DE ENTREGA A UN AGENTE DE ATENCIÓN AL CLIENTE AUTORIZADO)

Reclamos: Debe realizar todos los reclamos por escrito en una de nuestras oficinas principales o llamando a un agente autorizado que lo ayudará a completar el informe de reclamo. Debe notificarnos su reclamo dentro de los 7 días posteriores a la llegada del paquete. Si el destinatario acepta sus paquetes sin señalar anomalías en el recibo de entrega, determinamos que el paquete se entregó en buenas condiciones. Dentro de los veintiún (21) días siguientes a la notificación del siniestro, éste deberá documentarse enviándonos toda la información pertinente al respecto. La Fuente Cargo Corporation tiene noventa días (90) para dar una resolución final al cliente sobre el reclamo. No estamos obligados a actuar sobre ningún reclamo hasta que se hayan pagado todos los cargos de transporte; el monto de la reclamación no puede deducirse de esos cargos.

Nuestros derechos:
Podemos, a nuestro criterio y/o según la petición de las autoridades de aduanas, inspeccionar sus paquetes antes o después de haber sido entregados a nosotros para su envío; especialmente si ha decidido no presentarnos un documento de identificación. Nos reservamos el derecho de tomar fotografías de su envío en la recepción y entrega del mismo con fines de documentación, rastreo y material promocional o educativo.

Al firmar este contrato, usted acepta nuestros términos y condiciones y afirma las siguientes declaraciones:

– Juro que he leído y comprendo los términos y condiciones de este contrato.

– Juro que no estoy enviando materiales prohibidos o peligrosos que no estoy autorizado a enviar por regulación federal.

– Juro que he declarado en este contrato todos los artículos que envío.

– Juro que en caso de enviar carga comercial, conozco y he seguido el procedimiento para este tipo de envío.

– Doy permiso a La Fuente Cargo para enviar mensajes de texto con respecto a mi envío o con fines promocionales.

Please read these Terms and Conditions carefully before using our services operated by La Fuente Cargo Corporation.

Introduction: Welcome to La Fuente Cargo Corporation! By using the services we provide, you acknowledge that you have read, understood, and agree to be bound by our Terms and Conditions. These Terms and Conditions unconditionally extend and apply to all our services. If you are not in agreement with all of these Terms and Conditions, we may not continue to provide our services. La Fuente Cargo Corporation recommends that you save or print a copy of these Terms and Conditions for future reference.

Definitions/ Terminology: The following definitions apply to these Terms and Conditions, Privacy Statement, Disclaimer Notice and all Agreements: “You”, “Your” and “Client” refers to the shipper and the consignee. “We”, “Our”, and “Us” refers to La Fuente Cargo Corporation, its employees and agents. “Family parcel” refers to a package with first necessity items such as clothes, toys, shoes, hygiene products, vitamins or others meant to help a family in a country we ship to.  “Package” refers to any container that is accepted by us for delivery, including any such items tendered by you utilizing our automated systems, meters, manifests, or waybills. “Shipment” refers to all packages that travel under one waybill and which may be carried by any means La Fuente Cargo Corporations offers, including air, road, ship or any other carrier. All terms refer to all considerations of La Fuente Cargo Corporation necessary to undertake support to you for the express purpose of meeting your need in respect of our services, under and subject to, prevailing law of the state or country in which La Fuente Cargo Corporation operates. Any use of these definitions or other glossary in the singular, plural, capitalization, and/or pronoun are interchangeable but refer to the same.

Agreement to terms: La Fuente Cargo Terms and Conditions contained in this Agreement shall govern your use of our services. These Terms outline the rules and regulations guiding the use of the services provided by La Fuente Cargo. All information/package content/documents/services or all other entities that are provided by the client shall be administered subject to these Terms and Conditions. These Terms and Conditions apply in full force and effect to your use of our services, and by giving us your shipment you agree, regardless of whether you sign or not our waybill, for yourself or as an agent for and on behalf of any other person having an interest in this shipment, with all the terms and conditions contained herein in full. Our printed name shall be sufficient to constitute our signature on our waybill. You also agree to the Terms and Conditions on behalf of the consignee of the Shipment and any third party with an interest in the package. Do not continue to use our services if you have any objection to any of the Terms and Conditions stated on this page. In case any of these Terms and Conditions are not respected by the Client, we may terminate or suspend access to our Service immediately, with or without prior notice. Only La Fuente Corporation authorized personnel can change the Terms and Conditions of this agreement.

Your Obligations: You are responsible for adequately packing your goods and properly filling out this contract, describing each article on this shipment and giving the correct contact information. We are not responsible for the deterioration of goods and electrical appliances that have not been properly packaged.

You warrant that each article in the shipment is properly described on your waybill and any export documents, acceptable for transport by us, and properly marked, addressed, and packed to ensure safe transportation with ordinary care in handling.

You are responsible for shipping any electronic items in its original packaging with insurance and a purchase invoice to justify its declared value.

Additional Costs: Even if you have already canceled the total shipment or give us different payment instructions, you will also be responsible for any additional costs that the company has to incur related to your shipment, such as: governmental penalties and fines, taxes, lawyers’ fees and legal costs, warehousing costs, among others; your cargo can be withheld until these additional costs are also paid. 

In case your package has more weight than the recommended by us for its safety in transport, you are responsible for the additional costs or damages. 

In the event that the destination address of the cargo is within an area of difficult access or restricted by our logistics team due to security reasons, the client is responsible for any additional costs that must be incurred when moving to a delivery point authorized by us.

Payments:  Payments can be made by credit card, debit card or in cash; other payment methods can be offered only at our main offices, through our website or authorized personnel of La Fuente Cargo Corporation. We do not offer the option to pay our shipping services on credit or in installments, with the exception of special circumstances approved by authorized personnel of La Fuente Cargo Corporation.

Articles NOT allowed to transport:  By law, we are not allowed to transport any packages that contain gold, diamonds, silver, money, personal checks, personal documents, liquor, explosives, weapons, drugs and other restricted, hazardous or prohibited objects by United States customs or the countries we ship to. We are not responsible for the loss of any restricted objects named above.

We will not be liable:

• For electronic items such as tablets, cell phones, computers, appliances and others inside a family parcel. (SEE HOW TO SHIP ELECTRONIC ITEMS IN OUR WEBSITE)
• For your acts or omissions, including but not limited to improper or insufficient packaging, securing and addressing. (SEE TIPS TO PACK PROPERLY IN OUR WEBSITE)
• For any agreement made between the client and an independent sales person or a person representing an authorized drop-off location that does not comply with our terms and conditions.
• If you or the consignee violates any of the terms of this agreement.
• For the loss or damage of any restricted or prohibited items named above.
• For the confiscation by public authorities of merchandise that wasn´t declared as such.
• If the missing items you claim had not been previously declared and written down in your invoice.
• For loss, damages, delays or failure to provide information in connection with your shipment caused by events we cannot control including but not limited to acts of God, perils of the air, weather conditions, acts of public enemies, war, strikes, civil commotions, acts or omissions of public authorities. 
• For loss, damages, delays or failure to provide information in connection with your shipment caused by events we cannot control, including but not limited to acts of God, perils of the air, weather conditions, acts of public enemies, war, strikes, civil commotions, acts or omissions of public authorities (including customs and health officials) with actual or apparent authority.

Declared Value Limits: For the contents of a family parcel, regardless of destination, the maximum declared value is US$1,000, with the exception of special circumstances approved by authorized personnel of La Fuente Cargo Corporation, such as clothing or decoration for family events, weddings, birthdays, baptisms or others gifts given to a family. Every declared value in any shipment has to be justified with a purchase invoice.

Basic Insurance: Insurance is optional and only apply for new items with a purchase invoice that justifies the declared value; any claim due to partial loss of one or more of these items, that is not caused by a packaging or lack of safety mistake on the client’s behalf will be compensated within its declared value and purchase invoice. To apply for insurance, you should pay a percentage assigned to your destination country. If a client refuses insurance, any claim will be handled at the company’s discretion with a maximum compensation value of $500 for total loss.

Deliveries: Deliveries of the shipment will be made only at the indicated address and to the recipient indicated in your invoice. If the shipper authorizes delivery to a third party we will not be responsible for damages or the loss of the cargo. If your destination address is within an area of difficult access or restricted, we will deliver on the nearest point of delivery.  (ASK FOR OUR POINTS OF DELIVERY TO AN AUTHORIZED CUSTOMER SERVICE AGENT)

We will not deliver any packages to third parties without the authorization of the shipper (or recipient who gives accurate information about the shipment details), in which case, even with given authorization La Fuente Cargo Corporation is not responsible for any sort of claim due to missing items or damage in packaging. In the case of deliveries to third parties, it will be noted in the delivery receipt with the legal identification number of the third party. The consignee must write down their observations on the delivery receipt, pointing out any visible anomaly. Upon receipt, the consignee must sign their proof of delivery and a photo will be taken with their cargo for security reasons and for our database. These photos can be used in promotional material of La Fuente Cargo Corporation.

Claims: You must make all claims in writing at one of our main offices or by calling an authorized agent who will help you fill the claim report. You should notify us of your claim within 7 days upon the package arrival. If the consignee accepts your packages without pointing out anomalies on the delivery receipt, we determine the package was delivered in good condition. Within twenty-one (21) days after notification to us of the claim, it must be documented by sending to us all relevant information about it. La Fuente Cargo Corporation has ninety days (90) to give a final resolution to the client about the claim. We are not obligated to act on any claim until all transportation charges have been paid; the claim amount may not be deducted from those charges.

Our Rights: We may, at our choice or at authorities’ request, inspect your packages before or after you give them to us for shipping, especially if you have decided not to show an identification document. We reserve the right to take photographs of your shipment upon reception and delivery for documentation, tracking, and promotional or educational material. 

By signing this contract you are agreeing to our terms and conditions and with the following statements:

• I swear that I have read and understand the terms and conditions in this contract.
• I swear I am not shipping prohibited or hazardous materials that I am not allowed to ship by federal regulation.
• I swear that I have declared in this contract all the items I am shipping.
• I swear that in case of sending commercial cargo, I know and have followed the procedure for this type of shipment.
• I give permission to La Fuente Cargo to send text messages regarding my shipment or for promotional purposes.
